Licence type

To help the hospitality trade this summer, you can now apply for a temporary outdoor dining licence for dining on the footpath outside your business. Temporary licences are only available for a basic set-up of of tables, chairs and umbrellas and are valid until 2 May 2022


All other applications require a standard licence.

Location and access

To extend your business onto the footpath, the area must be directly in front of your business and not encroach onto neighbouring property.

Pedestrian access must be maintained on the footpath with a two metre clear path for people of all abilities and ages. If there is insufficient clear path for pedestrians, your licence will not be approved. 

 
Site plan

The following must be shown on your site plan:
  • Indication and dimensions of your proposed outdoor dining area. 
  • A two metre clear path on the footpath for pedestrians. 
  • Clear building entry and exit paths.
  • Your trading boundary. 
  • The surrounding context, including the location of existing street elements within the area, such as bins, planters, trees, posts, parking meters etc.
  • North point.

Use Canterbury Maps to help create a plan, if needed.


Design 

All street and dining furniture should be to a high standard of design and construction. All individual items such as chairs and tables should be complementary in design and appearance to the location.

The number of items should align with the proposed size of the site.


Alcohol licences

Under a temporary licence you are not permitted to sell alcohol or allow alcohol to be consumed in the outdoor dining area on the footpath. This is because an Alcohol Licence is required to sell and consume alcohol on the footpath which can’t be fast-tracked.



Smoke and vape-free

The Council aims to be a smoke and vape-free city by 2025. We encourage you to make your outdoor dining area smoke and vape-free to support this.


Public liability insurance

Outdoor dining areas are not covered by the Council’s public liability insurance. Licensees must have their own public liability insurance of at least $2 million.




Declaration

I have read and will comply with all the conditions in the Public Places Bylaw 2018, the Public Street Enclosures Policy, and any general requirements while undertaking hospitality activities on the footpath.

I understand that the information collected will be used to ensure the effective processing of my application. 


I give permission for information to be shared to other Christchurch City Council departments, external agencies such as the police or NZTA, and for public notification.
